Michael Mustard is a partner in the Fort Wayne, Indiana office. He practices in the areas of entity formation, commercial lending, commercial litigation, real estate and business acquisitions.

Mr. Mustard received his B.A. from the University of Notre Dame in 1973 followed by his Doctorate of Jurisprudence, cum laude, in 1978 from the University of Notre Dame School of Law.

He has represented business clients since 1978, in various commercial settings, including both lenders and borrowers in structuring, documenting and closing various commercial loan and SBA 504 transactions; sellers and buyers in asset transactions involving manufacturing facilities and equipment in Indiana, Michigan, Wisconsin, Pennsylvania, New York, North Carolina, Tennessee, Mississippi and Washington; the formation and structuring of various types of business entities as well as matters related to ongoing business issues; and providing litigation support in commercial litigation matters.  

He is also a Certified Closing Attorney for the U.S. Small Business Administration Section 504 loans division.

Recent Experiences:
Represented buyers in acquisitions of facilities and equipment in North Carolina, Tennessee and Mississippi from London-based international corporation, as well as representation in financing the various transactions.

Represented local United States Small Business Administration-certified development company under 504 loan program in various loan closings.

Assisted mid-sized entity in structuring and securing various credit facilities for asset transactions and financing for conduct of business in ordinary course.

Assisted condominium complex in obtaining financing for capital improvements project.

Represented regional and national banks in commercial loan transactions and in resolutions of defaulted loans.

Successfully represented bonding company in United States District Court wherein a third-tier material supplier for bridge construction project brought action against surety that issued performance bond to the project's general contractor, seeking payment under the performance bond. The United States District Court certified question of state law to the Indiana Supreme Court on a matter of first impression and resolved in May, 2007. Alberici Constructors, Inc. D/b/a Hillsdale Fabricators v. Ohio Farms Insurance Company, 866 N.E.2d 740 Ind (2007).
